 Michigan Legislature Bans Imposter Groups
The Michgan legislature has passed a bill designed to prevent imposter musical groups from profiting from famous names of the past, according to MichiganVotes.com. Introduced by Senator Martha G. Scott (D-Highland Park), Senate Bill 1125 amends the Michigan Consumer Protection Act to prohibit imposter groups from performing as established musical groups when there are no original members performing on stage. Introduced to the Michigan Senate on June 6, 2006, Senate Bill 1125 aims to protect artists from identiy theft and protect consumers from fraudulent claims by making it unlawful for a "performing group" to claim the same name as a famous "recording group", with the following exceptions:
  1. the performing group included at least one member of the recording group who had continuously used the group's name
  2. the performing group was an obvious salute or tribute to the recording group
  3. the performing group had the recording group's permission to use its name, or the performing group held the Federal service mark for the group name


The issue of artistic identity theft was originally brought to the attention of Senator Scott and The Natiional Foundation of Women Legislators by Motown legend Mary Wilson, formerly of The Supremes, according to a press release on the senator's webpage.

The "Truth In Music" campaign that started it all has been widely publicized by the Vocal Group Hall of Fame Foundation whose chairman, John "Bowzer" Bowman (formerly of Sha Na Na) testified on behalf of the bill in the Michigan Legislature. It has already become law in Pennsylvania, Connecticut, Illinois, South Carolina, and North Dakota and is pending in several others according to the foundation's website.

Senate Bill 1125 passed the Michgan Senate on June 13, 2006 and the the Michigan House on Dec 13th, 2006. It will now head to the governor's desk and, provided it is not vetoed, will automatically become law fourteen days after its passage in the house.
